In these terms and conditions, and across our website and communications “Jane”, “Jane Atelier”, “JaneAtelier.com”, “Jane Lewis Atelier”, “we” or “us” means Jane Lewis Fashion Ltd. “Customer” or “You” means the person buying or requesting services and / or products from Jane Lewis Fashion Ltd.

JaneAtelier.com is an online service of Jane Lewis Fashion ltd. (‘JaneAtelier.com/‘We’/‘our’/‘us’) provided solely for your personal use for the sale of clothing (‘Items’).

By accessing this website you agree to these terms and conditions (the ‘Terms’). If you do not agree to them you may not use this website and should leave it immediately. On our site we aim to provide you with a simple and enjoyable way to purchase a selection of our great styles. We also want to offer you the best possible level of customer service as well as protect your privacy. By making a purchase with us you will have deemed to have read, understood, and agreed to our terms and conditions. These terms and conditions shall be governed by and construed in accordance with English law. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the English courts.

INFORMATION ON OUR WEBSITE

We take great care to ensure that items on our website are presented as accurately as possible. However colour clarity will depend upon your personal monitor therefore, we cannot guarantee that the colour of any item will be represented absolutely accurately.

Prices are shown in GBP and USD on the US website and include VAT where appropriate. Prices are correct at the time of viewing but are subject to change at any time. VAT is charged in accordance with English law.

Whilst we try to ensure that the information on this site is accurate and complete we do not promise that the functional aspects of the site or the content therein will be error free or that the site, its content or the server that makes it available are free of viruses or other harmful components.  We always recommend that all users of the internet ensure that they have up-to-date virus checking software installed.

ELIGIBILITY

Individuals wishing to place an order with Jane Atelier must meet the Jane Lewis Fashion Ltd. terms of eligibility and agree to our terms and conditions and have been issued a valid credit/debit card by a bank acceptable to Jane Atelier.

In order to make purchases with Jane Atelier you will be required to provide your personal details. In particular, you must provide your real name, phone number, e-mail address and other requested information as indicated. You will also be required to provide payment details that you represent and warrant are both valid and correct and you confirm that you are the person referred to in the billing information provided.

By placing an order with Jane Atelier you agree that we may use personal information provided by you in order to conduct appropriate anti fraud checks. Personal information that you provide may be disclosed to a credit reference or fraud prevention agency, which may keep a record of that information.

REGISTRATION

Registration is for a single user only. You are responsible for the security of any passwords issued through janeatelier.com. If you know or suspect that someone else knows your password, you should contact us immediately.

We may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under these terms and conditions.

PLACING AN ORDER

We accept Paypal, Visa, MasterCard, American Express and Maestro cards.

You are deemed to have placed an order with us by ordering via our online checkout process and/or via telephone order. You will receive an email from us acknowledging the details of your order. This email is NOT an acceptance of your order, just a confirmation that we have received it.

Unless you cancel your order, acceptance of your order and completion of the contract between you and Jane Lewis Fashion Limited will be completed when we email you to confirm the goods have been dispatched. The sale contract is therefore concluded in London, England and the language of the contract is English.

We reserve the right not to accept your order in the event, for example, that we are unable to obtain authorization for payment, that shipping restrictions apply to a particular item, that the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn, or that you do not meet the eligibility criteria set out within these terms and conditions. We may also refuse to process and therefore accept a transaction for any reason or refuse service to anyone at any time at our sole discretion.

CANCELING AN ORDER

If you are based in the EU, in accordance to the Consumer Contracts Regulations 2013 (UK) you have a legal right to cancel a contract if you change your mind until 14 days after you receive (or someone you nominate receives) the products, unless the products are split into several deliveries over different days in which case you will have until 14 days after the day you receive (or someone you nominate receives) the last delivery.

We need written confirmation of cancellation from you, so you'll need to get in touch using any of our available contact options to let us know you'd like to cancel your order under the Consumer Contracts Regulations 2013. If you wish to cancel your order you can notify us by email at customercare@janeatelier.com before we have dispatched the goods to you; or where goods have already been dispatched to you, by returning goods to us in accordance with our returns procedure.

On receipt of your notice of order cancellation, client services will contact you with return instructions. Please note that you must cover the cost of the return shipment.

If you are returning your whole order all at once, a full refund will be processed for the items you have purchased and the cost of standard delivery if you’ve paid for shipping within 14 days of receiving your notice of contract cancellation. If only part of your order is returned, any delivery charge you paid won’t be refunded.

The rights to return the goods to us will not apply in the following circumstances: - in the event that the product has been used or damaged by you in any way or if the tags has been removed. This does not affect your statutory rights.

RETURNS

We hope you’re delighted with your order from www.janeatelier.com. If you’re not perfectly satisfied with your order, you may return the item for a refund. You must notify us of your return within 14 days of receiving your order. You then have 14 days to get the item back to us. To initiate your return, please log into your account or contact our Customer Service Team on 020 3773 8936 or customercare@janeatelier.com. Please note, returns outside of this period will be processed at the discretion on Jane Atelier and a credit voucher may be offered. Returns from the UK and USA are prepaid by Jane Atelier. Only one prepaid label will be provided per order. Items must be returned in their original condition with all garment tags attached. Returns that have been worn, used, altered or damaged will not be accepted and may be sent back to you and/or a refund refused. You are responsible for all products until returned to us. We are not liable for the loss of garments in return transit. We recommend using a traceable delivery method and taking note of your tracking number.

Refunds will be credited to your original method of payment. Original shipping charges, duties, taxes or tariffs will not be refunded. If your return was purchased in a currency other than your local currency, refunds will be paid in the same currency. Due to fluctuations in currency rates the amount refunded may be slightly higher or lower than the price originally paid.

If you are based in the EU, you may have the right to cancel your order however, you need to notify us of your decision to do so within 14 days of delivery. To exercise the right to cancel, please inform us by email at customercare@janeatelier.com.

PAYMENT

We accept payment in GBP If you are a customer whose credit/debit card is not denominated in Sterling the final price will be calculated in accordance with the applicable exchange rate on the day your card issuer processes the transaction. Payment will be debited and cleared from your account upon dispatch of your order. Payment can be made by Paypal, Visa, Visa Electron, Visa Debit, Visa Delta, MasterCard, American Express, Maestro debit cards.

PRIVACY STATEMENT

When you place an order with us we will ask you for some personal data. This data will enable us to contact you with regards to your order and notify you of any future products on offer. We may send you emails from time to time to inform you on the availability of new styles, special events or special offers. If you do not wish to receive these emails you can opt out at anytime by emailing UNSUBSCRIBE to customercare@janeatelier.com . We comply with the standards, procedures and requirements laid down in the UK Data Protection Act (1998) to ensure that the personal information you give us is kept secure and processed fairly and lawfully.

LIABILITY STATEMENT

Jane Atelier shall be under no liability in respect of any defects arising from fair wear and tear, wilful damage, negligence, abnormal working conditions, failure to follow the care instructions, misuse, or alteration or repair of the goods without prior approval. Jane Atelier shall not be liable for any indirect loss or damage costs, expenses or other claims for compensation whatsoever and the entire liability shall never exceed the price of the goods. Jane Atelier shall not be liable for any delays due to any cause beyond the company’s reasonable control such as: * Acts of God, explosion, flood, tempest, fire or accident; * War or threat of war, sabotage, insurrection, civil disturbance or requisition;* Acts, restrictions, regulations, bye laws, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority;* Import or export regulations or embargoes;

* Strikes, lock outs or other industrial actions or trade disputes.

INTELLECTUAL PROPERTY RIGHTS

Your use of the Jane Atelier website and its contents grants no rights to you in relation to any copyright designs, trademark and all other intellectual property rights relating to the content.  All such content including third party trademarks, designs and related intellectual property rights mentioned or displayed on the Jane Atelier website remain the property of Jane Atelier or its licensors and are protected by copyright laws and treaties around the world.  You may store, print and display the contents supplied solely for your own personal use.  You are not permitted to publish, manipulate, distribute or otherwise reproduce in any format any of the content or copies of the content supplied to you or which appears on the Jane Atelier website, nor may you use any such content in connection with any business or commercial enterprise.

YOUR ACTIVITY

You agree that you will be personally responsible for your use of the Jane Atelier website and for all of your communication and activity on and pursuant the site.  If we determine that you are or have been engaged in prohibited activities, were not respectful of other users, or otherwise violated these terms and conditions, we may deny you access to the sight on a temporary or permanent basis.
